6. Art Grafik will not be held responsible for any costs incurred, compensation or loss of earnings due to the unavailability or problems with the website servers that may cause viewing problems with the client’s website.
7. Art Grafik is not responsible for any costs incurred, compensation or loss of earnings if a preliminary deadline is not met. We will of course endeavour to honour any proposed deadlines, and work long and hard to ensure this is not a problem.
8. Art Grafik will optimize and work with our client to make their website ‘search-engine-friendly’ and will submit to the major search engines (including many minor ones), but we cannot be responsible on whether or not your website will definitely be included with a particular search engine, to whom it is at their discretion. Art Grafik can also not take responsibility for a website’s position within a particular search engine’s rankings.
9. Whilst websites are checked in Internet Explorer 6, Netscape Navigator 7 and Mozilla Firefox 2, Art Grafik can make no guarantees that websites will respond and function correctly in all browser types and versions. It should also be noted that there are inevitably subtle differences in the way browers display and present website material.
10. Art Grafik will endeavour to create websites that function with the majority of screen resolutions, but we cannot take responsibility for specific screen resolutions resulting in websites being difficult to view and use.
11. If a choice of design is presented, only one design is to be developed and worked upon for our client unless it is agreed upon in writing to do otherwise.
12. Art Grafik retains the right to reproduce, publish and otherwise display any material within our portfolio and/or websites, for the purposes of recognition, and to be credited with creation. This includes a small discreet link at the bottom of any website created by Art Grafik, linking to the Rave Web Design website.
13. When paid in full, websites become the property of the client. You must however agree that only one copy of a website can be made available on the World Wide Web and that any stock or personal photography/animation that has been provided to you by Art Grafik, remains the property of Art Grafik and therefore may not be used for other design purposes beyond the website provided without express permission.
Hosting and Domains
14. Art Grafik can make no promises as to the availability of a domain name. We will endeavour to obtain the name of your choosing. Once confirmed and purchased, the domain cannot be changed, and should our client wish to do so, it will be at their expense.
15. Should the domain or website content later prove to be unsuitable (illegal, or in copyright or trademark breach) Art Grafik reserves to right to remove the website at once without compensation to our client.
16. Art Grafik is not responsible for any interruption to hosting services. Whilst hosting is reliable, occasional maintenance is carried out, which on infrequent occasions may slow down or disrupt services. Art Grafik cannot accept losses caused by the unavailability, malfunction or interruption of hosting services.
17. Art Grafik reserves the administration rights to a domain name, whilst the legal ownership remains with our clients.
18. Art Grafik will email you at least 6 weeks prior to the domain name expiration. It is your responsibility to promptly let us know whether you wish to keep the domain and/or hosting. If you wish to renew the services payment is required within 30 days. Art Grafik will not be responsible for lost emails or missed registration of any domain name. It is our client’s responsibility to send written confirmation to us, along with payment, a minimum of two weeks before expiration.
If a domain name goes beyond 30 days without renewal it may be possible to retrieve the domain for a client. Art Grafik can make no guarantees, but if retrieval is possible our client will be responsible for the increased costs of regaining the domain.
18. Art Grafik, does not as a matter of course, undertake general maintenance or updates to a client’s website. If a client wishes for updates to be made on a regular basis, a maintenance contract will be created proportionate to the amount of work undertaken.
Graphic Design
20. Graphic Design work remains the property of Art Grafik, and will not be released until payment is received in full. Art Grafik retains copyright on all design work unless specifically released in writing.
21. We cannot take responsibility for any copyright or trademark infringements caused by material submitted to us, by our clients. We will not knowingly create any material that we suspect to cause a copyright or trademark infringement unless given proven grounds that such material has the correct permissions in which to be used.
22. If a choice of design is presented, only one design is to be developed and worked upon for our client unless it is agreed upon in writing to do otherwise.
23. Once a brief and costing have been agreed upon, any potential additional work is entirely at the discretion of Art Grafik. We reserve the right to charge for such additions. If substantial changes are requested by the client, amounting to approximately 50% or more of the time required to produce the material, then Art Grafik will be entitled to submit a new and separate brief to the client for written approval. Work will commence when such a proposal is signed, received and any potential, additional fees have been paid.
24. Whilst Art Grafik, can provide artwork to our clients in a number of suitable formats for print (including .eps, .pdf, .ai, .psd, .jpg, .swf, .bmp, .tiff …), we are not responsible if a third-party printing firm does not have the adequate and up-to-date facilities and/or software to process the client’s designs for print. In the rare event that such incompatibility may arise, we will make reasonable efforts to work with our client to ensure such graphic design work can be reproduced without problem.
25. Art Grafik is not responsible for any costs incurred, compensation or loss of earnings whilst work is being carried out on behalf of a client.

Payment
27. A non-refundable 50% deposit is required before work commences. Upon completion of the work, the other 50% is required before work is released to our client. Completion of payment is required no later than 30 days from the date of the invoice (unless by prior arrangement). Late payment of any invoice will induce a fee of 6%. Payment may be made by cheque (pound sterling or euros), bank transfer, or direct payment from your local bank.
28. Invoices are sent via e-mail (unless otherwise requested) in PDF format (http://www.adobe.com/products/acrobat/readstep2.html). Monthly maintenance invoices are sent via e-mail at the end of each month and should be paid in full within 14 working days or as per the invoice/agreement. Any late payment will induce a fee of 6%.
29. Should a cheque payment bounce, an additional fee of £50 will be incurred. Any work that may have commenced will be halted and remain the property of Art Grafik until payment issues have been resolved.
Links and Trademarks
Any links and logos used by Art Grafik for past clients within our website 'Rave Website Design' remain the intellectual property of said client, and are used with fair accordance as the creator of such material.
